Welcome to Habsburgo. These Terms and Conditions of Sale ("Terms") govern the offer and sale of products on our official website www.habsburgo.com ("the Site"). Please read these Terms carefully before placing an order.
By placing an order on this Site, you ("the Customer") fully and unconditionally accept these Terms. This document constitutes a binding contract between the Customer and Habsburgo.
2. Scope and Acceptance
These Terms apply to all sales of products made by Habsburgo to customers through the Site. Habsburgo reserves the right to modify these Terms at any time, without prior notice. The applicable version will be the one in effect at the time the Customer places the order.
3. Products and Availability
- Product Description: We strive to describe and present our products with the utmost accuracy. Each Habsburgo piece is conceived as a work of art, and the artisanal craftsmanship may result in minor variations inherent to the unique nature of precious metals and gemstones. These variations will not be considered defects. The product images on the Site are for illustrative purposes.
- Availability: All orders are subject to product availability. Many of our pieces are made to order. In the event that a product is unavailable after an order has been confirmed, we will notify you as soon as possible to offer an alternative or a full refund. We reserve the right to limit the quantities of any product we offer.
4. Order Process and Contract Formation
- Customer's Offer: By completing the checkout process and placing an order through the Site, the Customer makes a formal offer to purchase the selected products.
- Order Acknowledgment: The Customer will receive an automatic email acknowledging receipt of their order. This email does not constitute acceptance of the order but is a confirmation that we have received it.
- Acceptance and Contract Formation: The contract of sale is considered concluded only when Habsburgo sends a second email confirming that the order has been processed and the products have been dispatched ("Shipping Confirmation").
- Right of Cancellation by Habsburgo: We reserve the right to refuse or cancel an order for legitimate reasons, including, but not limited to, product unavailability, errors in the product description or price, or if we suspect fraudulent or unauthorized activity.
5. Pricing, Taxes, and Payment
- Currency: All prices are displayed in US Dollars (USD) and are valid at the time of purchase.
- Exclusion of Taxes and Duties: The prices displayed on the Site DO NOT include import taxes, customs duties, or local taxes (such as VAT or other sales taxes) that may be applied by the destination country. The Customer is solely responsible for all such charges (see Section 6).
- Payment Methods: We accept payments through the secure providers OpenPay (BBVA) and PayPal. Payment must be completed in full at the time the order is placed. Products will not be dispatched until payment has been verified and received in full.
6. Shipping and Delivery
- Shipping Destinations: We ship to the countries specified in our shipping policy, with the exception of the Russian Federation and Iran.
- Order Processing: Orders for in-stock pieces will be processed within 1 to 3 business days. For made-to-order pieces, the production time will be communicated to the Customer.
- Shipping Costs: Shipping costs are calculated at checkout and are borne by the Customer.
- Delivery Times: Delivery times are estimates and may vary due to factors beyond our control, such as customs clearance processes in the destination country.
- Carriers: We use reputable international courier services through our logistics partner Envia.com to ensure safe and efficient delivery.
7. Customs, Duties, and Import Taxes
The Customer acts as the importer of record in the destination country. As such, the Customer is solely and exclusively responsible for the payment of all tariffs, import taxes, customs fees, and any other charges levied by their country's authorities.
Habsburgo has no control over these charges and cannot predict their amount. The Customer's refusal to pay such charges, and the consequent refusal to accept the order, will not be grounds for a refund of the product or the original shipping costs by Habsburgo.
8. Transfer of Title and Risk of Loss
Title to and risk of loss or damage to the products transfer from Habsburgo to the Customer at the moment we hand the package over to the international carrier. From that point forward, Habsburgo is not responsible for the loss, theft, or damage of the package during transit.
9. Returns and Exchange Policy
At Habsburgo, we strive for your complete satisfaction, in line with our promise of excellence.
- Eligibility: The Customer may request a return of a product within fourteen 30 calendar days from the date of receipt. To be eligible for a return, the product must be in its original, unworn, and undamaged condition, with all original packaging, including boxes and documentation.
- Exclusions: Custom, engraved, or bespoke pieces are not eligible for return or exchange.
- Process: To initiate a return, the Customer must contact our customer service team at [email protected].
- Return Costs: The Customer is responsible for all costs associated with the return shipment, including transportation, insurance, and any applicable customs duties for the product's return to Mexico. We recommend using a trackable and insured shipping service, as we are not responsible for items lost or damaged during return transit.
- Refunds: Once the returned item is received and inspected by our team to verify its condition, we will process the refund to the original method of payment. Original shipping costs and any duties paid by the Customer are non-refundable.
10. Authenticity and Warranty
- Authenticity: We guarantee the authenticity of all Habsburgo pieces. Each creation is a testament to our commitment to distinctive design, the highest quality materials, and masterful craftsmanship.
- Manufacturing Warranty: We offer a limited one 1 year warranty against manufacturing defects from the date of purchase. This warranty does not cover damage resulting from normal wear and tear, accidents, improper care, exposure to chemicals, or any modification performed by a third party.
11. Intellectual Property
All content on the Site, including but not limited to, jewelry designs, images, text, graphics, and logos, is the exclusive property of Habsburgo and is protected by intellectual property laws and international treaties. Its unauthorized reproduction or use is strictly prohibited.
12. Limitation of Liability
To the fullest extent permitted by law, Habsburgo's total liability for any claim arising from the purchase of a product shall not exceed the purchase price of said product. Habsburgo shall not be liable for any indirect, incidental, or consequential damages.
13. Governing Law and Jurisdiction
These Terms and all related transactions shall be governed by and construed in accordance with the laws of the United Mexican States.
Any dispute arising in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Mexico City, Mexico. This clause does not prejudice the mandatory rights that the Customer's local consumer protection legislation may grant them.
